If this is your first divorce or family law case, you should be ready to hear the word "Retainer". A retainer fee is paid at the onset of your family law case whether it be divorce, legal separation, child custody case, modification case, child support case, paternity case or domestic violence matter.

The retainer fee is an up-front payment to the attorney which is money set aside to work on your case. The elements determined in the retainer fee are directly related to some of the following:

* Type of Case
* Issues involved in case
* Anticipated time your case will take to resolve
* length of marriage
* Number of properties and assets to be divided
* The experience and skill of the attorney hired

You may wonder why retainer fees vary. There is a great variance between the skill and experience of a 25 year family law attorney to that of a new or general practice lawyer. Perhaps the best answer is -you get what you pay for.
