If you are fearful of child abduction, you may be spending many a nights without sleep in fear of the other parent kidnapping your child. It is unfortunate but child abduction occurs often especially within the state the child lives. However, with our close proximity to Mexico, it happens out of country and out of state as well.

We see parents who try to flee the state in an attempt to get court orders in another state awarding custody of the child. In response to this problem, the fifty states have adopted the Uniform Child Custody Jurisdiction Act.

This is a federal law that brings common laws to the states when a child is removed from one state to another. The purpose of the UCCJEA is to eliminate two separate and conflicting child custody orders in two separate states. This helps ascertain if another court has jurisdiction over the custody matter, often ordering the case be returned to the court that has jurisdiction.

If you are concerned about child abduction, immediately seek the advice of our family law attorneys to determine what is in your best interest and your child's as well.
