Changing Assets and Insurance in Divorce

Don't Cancel the Insurance

In a Divorce proceeding, certain restraining orders are in effect under Family Code Section 2040.

The cost of Insurance is ever increasing. When going through Divorce you may be looking for ways to cut costs. Don't change the Insurance. Under the Family Code when in a divorce, either party is restrained from:

Cashing, borrowing against, canceling, transferring, disposing of, or changing the beneficiaries of an insurance or other coverage geld for the beenefit of the parties of their minor children.

These restraints pertain to both the Petitioner and Respondent until such time as a Judgment is entered or the court makes further orders.

If a spouse changes the Insurance, discuss with our skilled attorneys, concerning an order to reinstate the policy.
