Depositions in Divorce

Gathering and discovery information can be vital in a divorce proceeding. Sometimes one person hides all the financial documents or will not provide information relating to his/her business. Information relating to this must be established in order to ensure an equitable settlement or award in court.

The discovery process is essential and relates to gathering a thorough understanding of the marital finances such as assets, debts, wages, real estate values, pension plans, commissions, insurance, personal proerty, business value and more.

Generally, your experienced attorney will demand documentation from the opposing party through Interrogatories. When additional answers are required, a deposition can be conducted face to face, with the lawyers asking questions of the witness. This usually takes place at one lawyers office with no judge present. A court reporter is present as well.

Parties to a lawsuit are allowed to be deposed if they possess information that is relevant and necessary in order to fully investigate the case at hand.
