Reasons to file first in Court for Divorce and Child Custody

Many people wonder why they should be the first party to file in a divorce or Paternity matter in California. 

When your ex and yourself are unable to agree to child custody, assets, or financial issues, your case may have to go to a Family Law judge to make the decision. This is not always the preferred method of handling a child custody matter because you are putting the decision in the hands of the court rather than reaching an agreement with the other parent, which may work for both of you.

When all avenues are exhausted and the courtroom battle must take place, the requesting party who we are filing the motion for will be heard first. Our evidence is heard first relating to physical custody of the children. The responding party is then put into a defensive posture. With that being said, you need strong skilled legal representation, and most certainly well respected counsel advocating for you in court. Having well established knowledge of the court clerks, and judges makes a world of difference.
