What are Ex-Parte Family Law Matters ?

Ex-Parte Motions

Ex Parte motions in our local Riverside and San Bernardino County Courts are applications for an order which is made to the opposing party or his/her attorney with little notice, usually 24 hours or less. The cause is usually for certain protective orders which would otherwise result in great or irreparable injury. This short notice relief motion is based upon Family Code Section 241.

An Ex-parte order is based on an emergeny, not at urgent matter. In other words, there must be a risk involved or imminent danger at hand. When the court believes that an ex-parte is warranted it will be set to be heard by the Judge.
